Service Terms

All projects will be defined by a written statement of work (SOW) that outlines:

• Deliverables and milestones

• Pricing and payment terms
• Client responsibilities and requirements

Client Responsibilities

Clients are responsible for:

• Providing accurate and complete information
• Timely feedback and approvals
• Access to necessary systems and resources
• Payment according to agreed terms
• Compliance with applicable laws and regulations

Intellectual Property Rights

Unless otherwise specified in the SOW:

• Client retains ownership of pre-existing intellectual property
• Fortbubble retains ownership of proprietary methodologies and tools
• Custom-developed code and deliverables become client property upon full payment
• Third-party components remain subject to their respective licenses

Payment Terms

Pricing and Invoicing

Service pricing will be specified in the SOW. Payment terms are typically:

• 50% deposit upon project initiation
• Remaining balance upon project completion
• Net 30 days for ongoing services
• Late payment fees may apply after 30 days

Refund Policy

Refunds are considered on a case-by-case basis and are subject to:

• Work completed and deliverables provided
• Client's compliance with terms and responsibilities
• Project cancellation circumstances
• Written agreement between both parties

Confidentiality and Non-Disclosure

Both parties agree to maintain confidentiality of:

• Any information marked as confidential

This obligation survives termination of the service agreement.

Compliance

Services are provided in compliance with applicable laws and regulations, including but not limited to:

Limitation of Liability

To the maximum extent permitted by law:

• Fortbubble's liability is limited to the amount paid for services
• We are not liable for indirect, incidental, or consequential damages
• Clients are responsible for their own security measures

Indemnification

Clients agree to indemnify and hold harmless Fortbubble from claims arising from:

• Client's misuse of services or deliverables
• Violation of third-party rights
• Non-compliance with applicable laws
• Client's negligence or misconduct

Termination

Termination by Client

Clients may terminate services with written notice, subject to:

• Payment for work completed
• Return of confidential information
• Transfer of project materials
• Termination fees as specified in SOW

Termination by Fortbubble

We may terminate services for:

• Non-payment of fees
• Breach of terms or confidentiality
• Unreasonable client demands
• Safety or security concerns

Dispute Resolution

Any disputes arising from these terms or services will be resolved through:

• Good faith negotiation between parties
• Mediation if negotiation fails
• Binding arbitration as final recourse

Force Majeure
